Hawaii Bill to Remit Property with Report

Update on SB 2748: The Consumer Protection Committee recommended that the bill be passed, unamended, on February 7, 2012. The Judicial Committee acted similarly on February 10, 2012. On February 24, 2012, the Ways and Means Committee recommended the bill for passage, with amendments. It was then sent to the House, where it was referred to the House Judicial and Finance Committees. It has passed the Judicial committee and is scheduled for a hearing in the Finance Committee on Wednesday.

State of HawaiiCurrently, Hawaii statutorily has a two report process, like California's notice and remit reports. However, Hawaii does not send additional due diligence letters like California does between the notice report and the remit report. Therefore, there seemed to be little to no reason for the two report system in Hawaii. Administratively, Hawaii has accepted both the report and payment at the November 1st deadline, if companies preferred to submit the report only once. This was a particularly attractive option to those companies that had only minimal property to report to the state.

In an effort to clarify the remittance requirements and bring the process in line with the majority of fall states, Representative Say has introduced House Bill 2486 in January. Currently, H.B. 2486 has passed the first reading and was referred to the Judiciary and Finance committees.

S.B. 2748, introduced by Senator Shan Tsutsui, is the companion bill to H.B. 2486 in the Hawaii Senate. The Senate bill was referred to the Commerce and Consumer Protection and Judicial and Labor Committee (CPN/JDL) and the Ways and Means Committee. The CPN/JDL Committee scheduled a public hearing for February 7, 2012.
